Money Port Platform — User Trading Policy (P2P)

This Policy applies to all users, both buyers and sellers, on the Money Port platform.

I. All Users Must Comply with KYC, AML/CFT, and Legal Compliance Principles

  1. Users must strictly comply with the Platform's Know Your Customer (KYC) policy, including real-name verification requirements, covering both the User's personal information and any accounts linked to P2P trading. Users must legally register any account they use on the Platform and confirm it is used only by them.
  2. If the Platform's anti-money laundering (AML) or counter-terrorism financing (CTF) alerts are triggered, Users must actively cooperate with the Platform and provide the risk-control evidence required at the time, in accordance with the applicable risk-control measures.
  3. If a User fails to comply with Section I.2, the Platform has the right to deactivate their account.
  4. Users are responsible for ensuring they have the legal right to transact under applicable law. The Platform bears no responsibility for the legality of a User's transactions. The Platform is not a party to any P2P transaction between Users; however, where it deems necessary (though not obligatory) to help ensure transactions comply with legal requirements, the Platform may review the legality of a User's transactions and take action in accordance with applicable law.
  5. Users must use the Platform lawfully in accordance with the laws of their home jurisdiction and comply with all other applicable laws and regulations. Users are also responsible for all tax obligations required by local law, including withholding, collection, reporting, and remittance to the relevant tax authority.

II. General Trading Guidelines

  1. Before starting an order, always carefully read the terms written on the ad's description page, to avoid disputes arising from a misunderstanding of rights after the order has started.
  2. It is recommended that terms be written clearly, section by section.
  3. Verify that the payment method used during the order matches the payment method selected in the ad's settings.
  4. You must not conduct any trade through third-party channels such as social media, chat/messenger apps, or in-person/face-to-face exchange. The Platform bears no responsibility, and cannot be held responsible, for any financial loss or damage arising from transactions conducted or initiated outside the Platform. The Platform sets trading rules between Sellers and Buyers solely to support the user experience and is not a party to any P2P transaction.
  5. While using the Platform — including chat with other users, live customer service chat, and order comment sections — Users must not use abusive or inappropriate language.
  6. Both parties to a trade are responsible for any additional transfer costs (e.g., fees charged by a payment service provider), unless one party explicitly agrees before the trade begins to cover those costs itself. The transfer amount should therefore account for transaction costs (example: if an order totals AUD 10,000 and the payment service provider charges an additional AUD 5, the Buyer pays AUD 10,005 instead of AUD 10,000). The Seller always receives the full order amount; the Buyer is always responsible for any fee charged by the payment service provider.
  7. Payment methods that do not display the payer's name to the Seller are prohibited, since the Seller cannot verify that the payer matches the registered name. If a dispute arises from use of a payment method that does not display the real name, the Buyer bears the resulting loss.

III. Buyer Guidelines

  1. Use a payment method supported by the Seller and transfer the amount stated on the order page within the time set by the Seller. After paying, you must click "Transferred, Notify Seller."
  2. Use a payment method whose account holder name matches your name as verified on the Platform (it must exactly match your verified individual or entity name on the Platform). The Platform does not support payment methods that are not verified under a real name. If you use one anyway, your P2P function will be suspended for at least 7 days. If a dispute arises and it is determined the Buyer sent third-party payment information, the Buyer alone bears the loss for that order.
  3. Only send payment to a Seller account whose name matches the name registered on the Platform. The Seller's bank account name must exactly match their verified account name on the Platform. Paying into a third party's account is prohibited.
  4. Do not click "Transferred, Notify Seller" before payment is complete. Clicking this button before payment has actually been made or completed may result in your Account being suspended.
  5. If the Seller's chosen payment method is "instant payment" or "fast payment," you must not use a different method (e.g., an international transfer) without the Seller's prior consent.
  6. If you have paid and clicked "Transferred, Notify Seller," but the Seller does not deliver the corresponding funds within the time set, first contact the Seller through the chat tool. If, after confirming you followed the Platform's procedures correctly (including providing lawful evidence meeting the Platform's requirements), the Seller still does not respond, you may file a complaint against the Seller.

The P2P team may help resolve complaints in accordance with the dispute resolution rules, at a User's request. However, because the Platform is not a party to the P2P transaction, it bears no obligation to participate in any dispute between Users. The Platform reserves the right to give final interpretations and decisions on complaints, and decides at its own discretion, case by case, whether to reopen a complaint.

  1. If the Buyer Guidelines are violated, the Platform may take any action it deems appropriate under this Policy, the Terms, applicable law, or its own discretion — including freezing the violator's Account or disabling any account function on the trading platform and/or the Platform.
  2. When posting an ad, any buyer guidance stated in the ad's trading terms must not conflict with the rules of this User Trading Policy (price, fees, description, etc.).

IV. Seller Guidelines

  1. The name on the account used to receive payment must match the name registered on the Platform (it must exactly match your verified account name on the Platform).
  2. If a dispute arises and it is determined the Seller sent third-party payment information, the Seller alone bears the loss for that order.
  3. After confirming receipt of the Buyer's full payment, the Seller must complete the order (transfer the AUD to the Buyer) within 15 minutes.
  4. Unless otherwise specified by the Platform, Customer Service cannot be required to cancel an order without the Buyer's consent.
  5. The order price agreed between Seller and Buyer is final and non-negotiable.
  6. For any order that is incomplete or in dispute with a Buyer, the Seller must remain reachable at all times via the phone number and email registered on the Platform.
  7. For any additional fee charged by a payment service provider, the Seller must provide transaction evidence clearly showing the amount withheld.
  8. When posting an ad, any seller guidance stated in the ad's trading terms must not conflict with the rules of this User Trading Policy (price, fees, description, etc.).
  9. If the Seller Guidelines are violated, the Platform may take any action it deems appropriate under this Policy, the Terms, applicable law, or its own discretion — including freezing the violator's Account or disabling any account function on the trading platform.

V. Risk Warning and Disclaimer

Users must fully understand the risks associated with P2P transactions, including exchange-rate fluctuation risk, counterparty credit risk, and fiat-currency transaction compliance risk. Users must have sufficient knowledge, experience, and ability to assess these risks, and must independently bear all risk arising from participating in P2P transactions.

For their own security, Users must not disclose personal information (phone number, social media handles, messenger IDs, etc.) in trade terms, auto-replies, or order chat. Users must not include the names of local banks or payment systems, personal information, or other sensitive terms in their nickname. Users must not trade using multiple accounts on the P2P platform; if such accounts are discovered, the Platform has the right to block all related accounts from trading.

Before conducting a P2P transaction, you must read and understand the full content of this Policy, the Terms, and related platform rules. The Platform is not a party to P2P transactions, so any dispute between Users is not connected to the Platform, which bears neither the right nor the obligation to resolve such disputes. Neither party owes the other financial or non-financial liability (including compensation) through the Platform. You agree to grant the Platform authority to take all appropriate action (including cancelling transactions and disabling account functions under certain conditions) to protect your legal rights, the Platform's rights, and the legal rights of other Users, in accordance with this Policy, the Terms, and related Platform rules.

Please note that payment methods shown on the Platform are simply fiat transaction options between Users. Listing a payment method on the P2P platform does not establish any business relationship with that payment method's provider.

VI. Abnormal Trading Behavior and Response Measures

To the maximum extent permitted by law, you agree the Platform bears no liability for losses you incur from using P2P transactions or services under this Policy, except where caused by the Platform's intentional acts or gross negligence — this exclusion covers events such as hacking, power outages, and unavoidable technical failures.

In the following cases, the Platform has the right, at its sole and absolute discretion and without prior notice, to restrict, suspend, or terminate your access to your Account or the Platform's services for a specified period:

  • There is reasonable suspicion you have violated, or may violate, this Policy;
  • It is discovered you are using multiple accounts on P2P;
  • The Platform determines it necessary to protect other Users;
  • You are found to be using the Platform in a way that negatively affects or obstructs other Users' use of the Services;
  • In interactions with other Users, you have used abusive or defamatory language, demanded money through illegal means, harassed or threatened another User, violated or attempted to violate another User's legal rights (privacy, publicity, intellectual property, etc.), or collected and distributed another User's personal information.

If the Platform exercises its right to restrict or deny your access to the Service, it bears no liability for any resulting delay, loss, or inconvenience.

You acknowledge that decisions to restrict, suspend, or close your Account may be based on confidential criteria that are important to the Platform's risk-management and security protocols, and you agree the Platform is under no obligation to disclose the details of those procedures to you.

Once the reason for a suspension no longer applies, the Platform will lift it as quickly as reasonably possible, but is under no obligation to notify you in advance of when (or whether) a suspension will be lifted.

Abnormal Trading Behavior and Corresponding Action

#Abnormal BehaviorAction
1Buyer cancels an already-placed order for their own reasons, without the Seller's prior consent.If a Buyer does this 3 times in one day, the system will refuse to provide P2P service to them for the remainder of that day.
2Buyer cancels an order that arose due to the Seller's reasons, where the Seller has agreed to the cancellation.Same as above: 3 times in one day → P2P service refused for the remainder of that day.
3Buyer cancels an order because they do not want to complete the Seller's verification process.Same as above: 3 times in one day → P2P service refused for the remainder of that day.
4An order is automatically cancelled because payment was not made within the time set after the order was created.If a regular User acting as buyer does this 5 times in a row, the system prohibits them from buying for 24 hours, their active buy ads are automatically closed, and posting new buy ads is prohibited for 24 hours. If a merchant acting as buyer does this 8 times in a row, their active ads are automatically closed.
54 or more of a User's orders are simultaneously under complaint/dispute.All of the User's active ads and their P2P service are temporarily suspended.
6A User's buy ad has been active for a relatively long time but has a completion rate below 20%.The User's buy ad is closed.
7Some of a Seller's/Buyer's orders are repeatedly cancelled by the Buyer, and the Seller does not respond to the Buyer in the order chat.Buyer: 1st violation — warning. 2nd violation — buy function suspended for 1 day. 3rd or later violation — buy function suspended for 3 days. Seller: 1st violation — warning, all sell ads closed. 2nd violation — sell function suspended for 1 day, all sell ads closed. 3rd or later violation — sell function suspended for 3 days, all sell ads closed.
8A Seller's sell/buy ad has been active for a certain period but has a completion rate below 20%.1st violation — warning, all buy ads closed. 2nd violation — buy function suspended for 1 day, all buy ads closed. 3rd or later violation — buy function suspended for 3 days, all buy ads closed. Note: if the maker's completion rate over the last 30 days is above 80%, only the 2nd-violation rule applies.

Risk-Control Trigger Events and Corresponding Action

#EventAction
1The risk-control system detects abnormal behavior, and the User openly refuses or fails to actively cooperate with follow-up AML/CTF verification.The Platform will immediately treat the relevant account(s) as abnormal, raise the risk level, and may immediately freeze the relevant account(s) until the risk-control evidence the User provides passes the Platform's review.
2A User's account is suspected of fraud (or attempted fraud), of transferring funds to a high-risk platform — including unlicensed crypto-dealer platforms, online gambling platforms, platforms suspected of money laundering or fraud, or other high-risk entities — or of other high-risk asset transfers.The Platform may immediately freeze or disable the relevant Account(s)' transactions, withdrawals, or all P2P functions.
3The account was not used by the registered User themselves, or was used to unlawfully purchase digital assets on someone else's behalf; it is confirmed the User sold, lent, or rented their account to another person, or unlawfully purchased digital assets on someone else's behalf. Risk warning: protect your account information to prevent it being used by others for criminal purposes.The Platform may take necessary measures, including temporarily or permanently disabling P2P trading functions, delaying or disabling withdrawal functions, or immediately freezing such Users' accounts and related accounts.
4Receiving or depositing digital or monetary assets from an unlawful source. The User knows, or could reasonably be expected to know, that assets received from another platform have an unlawful origin, but allows them to be passed on into other Users' accounts on the Platform.The Platform may immediately and permanently disable all or some functions of such Users' accounts and related accounts, and may terminate the services or contractual obligations provided to those Users.
5A User is determined to be connected to money laundering — detected by the risk-control system, or confirmed by a risk-control officer to be directly involved in, or assisting with, money laundering.Same action as row 4 above.
6An account is frozen at the request of a judicial authority.The Platform may freeze an account at the written request of a judicial authority, in accordance with applicable law. While frozen, the User must resolve the matter with the relevant judicial authority, not with the Platform.
7Law enforcement investigation: a judicial authority requests a User's Platform account information via judicial investigation, inquiry, or similar formal process.The Platform may disable some functions of the User's account and related accounts.

Translator's note: row 7 of the first table names the two parties "Худалдан авагч" (Buyer) and what appears to be a typo for "Худалдагч" (Seller) in your source ("Хупалпагч") — I've translated it as Seller, since that's the only reading that makes the two-sided warning structure consistent with row 8 and the rest of the policy. Worth double-checking against your original intent before publishing.
